True that you can not file a chapter 7 bankruptcy with credit card debt?


You can only file chapter 13? Is that true?

    Not true. You can file Chapter 7, Chapter 13, and maybe Chapter 11 if you are a small business. In fact one way to look at them, Chapter 13 rules might be more restrictive than the others. You will need to have certain amount of disposable income (or assets) to file for Chapter 13.

    File for Chapter 7 to start and if you meet the requirements, some of your debts will be forgiven. If not, they will put you on a debt reorganization 5-year plan (i.e. Chapter 13).
