Does it matter if you’ve recently used your credit card when filing for bankruptcy?
I’m am going to be filing for bankruptcy soon but I really need to get a uniform for my job and I want to use one of my credit cards that I still have room on to buy it. I was wondering if it matters if one of my cards was recently used when filing?
No it does not matter if you have not yet filed.
Even the federal bankruptcy courts now allow filing fees to be paid by credit card (see source).
New Bankruptcy Laws that took effect on October 17, 2005 do not allow the following: debts you incurred on the basis of fraud, such as lying on a credit application; Credit purchases of $500 or more for luxury goods or services made within 90 days of filing; Loans or cash advances of $750 or more taken within 70 days of filing.
The purchase of a uniform required in the performance of ones occupation I should think would not be considered a fraud and would most likely get discharged in a chapter 7 or 13 if the credit card company accepts the filing.
Make sure to include this purchase in your filing, any purchases you fail to include will not be discharged.

You haven’t filed yet but the credit card company may question this purchase when they receive your intent to file. Borrow a few bucks from a friend or relative.

Yes it does, the bankruptcy court doesn’t look to kindly upon credit extended 90 days prior to filing for bankruptcy. Check with your attorney.
